Please review the following terms carefully before securing your booking with rollsbysam.
1. Booking & Payment Terms
- The Advance: A 50% non-refundable retainer is required to secure the shoot date and time. No date is reserved until this payment is received.
- The Balance: The remaining 50% balance must be paid in full prior to the delivery of the final high-resolution, color-graded images.
- Invoicing: All payments will be documented and officially receipted.
2. Cancellation & Rescheduling
- Client Cancellation: If the client cancels the shoot, the 30% advance retainer is forfeited to cover lost booking opportunities.
- Rescheduling: Clients may reschedule once, provided they give at least 48 hours' written notice via email. The retainer will transfer to the new date.
- Artist Cancellation: In the unlikely event that rollsbysam is unable to perform the duties due to severe illness or emergency, a full refund of the retainer will be issued, or a new date will be negotiated.
3. Artistic Discretion & Color Grading Protocol
- The Process: The client is commissioning the artist specifically for their technical execution of creative vision & editing. All color grading and editing decisions are at the strict creative discretion of the artist.
- Raw Files: Under no circumstances will unedited or RAW photographic files be released to the client. The final deliverables represent the finished artwork.
- Revisions: The agreed-upon fee includes the standard color grading process. Additional extensive retouching (e.g., extra adjustments, altering body shapes, background manipulation) falls outside the standard scope and will be billed at an extra charges
4. Deliverables & Turnaround Time
- Digital galleries will be delivered within 1 to 2 weeks following the shoot date. (Note: You can change this number in the code if needed).
- The client is responsible for downloading and backing up their files within 30 days of gallery delivery.
5. Copyright & Usage Rights
- Ownership: rollsbysam retains the copyright to all images created.
- Client Usage: The client is granted a license for personal, non-commercial use of the images. Any commercial use (e.g., selling the images, using them for a large-scale advertising campaign) requires a separate commercial license agreement.
- Portfolio Rights: The artist reserves the right to use the final images for promotional purposes, including social media, marketing materials, and the official portfolio, unless a strict Non-Disclosure Agreement (NDA) is signed prior to the shoot.
6. Liability & Force Majeure
- Equipment Failure: While the artist uses professional gear and backup systems, in the unlikely event of total catastrophic equipment failure, data loss, or theft, liability is strictly limited to the refund of all money paid by the client.
- Force Majeure: The artist is not liable for delayed or unfulfilled obligations due to extreme weather, natural disasters, or other conditions beyond their control.
7. Governing Law & Dispute Resolution
- This agreement shall be governed by the laws of India. Any legal disputes or claims arising out of this agreement shall be subject to the exclusive jurisdiction of the courts located in Varanasi, Uttar Pradesh.
